Through these CONTRACTUAL TERMS OF THE SERVICES, GLOBILES, S.L., hereby informs the users of the website accessible through the URL https://prohire.me (hereinafter "ProHireMe"), that is operated and managed by the company GLOBILES, S.L with address at C/ Jarama, No. 6, Madrid, CIF B-85760809 and registered in the Mercantile Registry of Madrid, Volume 26988, Folio 120, Page M-486 270 (hereinafter, "GSL").
These "Contractual Terms of the Services" (hereinafter "CTS") shall apply to the services procured through the ProHireMe.
ProHireMe offers interested users the tools and resources needed in the job search process, contributing in particular, materials, tools, knowledge and advice aimed to facilitate and improve job search, both for those searching for a job and for those helping, coaching and advising them on this process.
1. Access to free services and prerequisites for the purchase of and / or access to subscription services.
As indicated in the legal texts that are integrated in ProHireMe, the user can browse through the public area without registration, or through the private area, for which prior registration or payment of contracted services in their various forms, as specified in the CTS, is mandatory.
In order to use the services offered in the private area of ProHireMe, the following are required:
With registration, the user can enjoy access to the content and functionality associated with the free account, and can upgrade the account at any time to additional services, selecting the subscription service he/she wishes to purchase and completing the payment process through the forms provided, via PayPal. All payments are completed through PayPal and therefore GSL has no access to the user's payment details.
GSL will not be part of the user's contractual relationship with PayPal, and therefore will not seek or have access to any personal data the user provides to PayPal, either during or as a result of registration or during payment. GSL assumes no liability arising from or related in any way to the breach by PayPal of its obligations before the user, but will cooperate with authorities in investigation of any irregularity.
2. Subscription and access to services offered through ProHireMe.
Subject to the user's prior acceptance of the CTS, and, if appropriate, payment for the service under the subscription process outlined in the previous section, the user may access any of the contracted services offered by GSL through ProHireMe following the contractual process set by the system and after having completed the two steps described in the previous section.
If for any reason following confirmation of the subscription, payment is not completed for any reason, GSL will preserve the email address registered in the system, in order to be able to send further communications informing the user that the process payment has not been completed.
Once payment has been completed and GSL has received the confirmation from PayPal, the user's account will be updated to allow immediate access to the content, pages and functionality corresponding to the account level subscribed.
A registered user is entitled to make use of all the functionality corresponding to the level of account he/she has subscribed. The description of the different levels of account, their functionality and their pricing can be found using the following link: .
Notwithstanding, some applications within ProHireMe are functionally independent and are not integrated in the ProHireMe platform. These applications have been licensed and/or provided by third parties and in these cases, GSL assumes no obligation or responsibility for the proper and correct working of the same.
The user will have access to the subscribed services and the information generated in his/her account based on the subscription plans.
In the case of subscription paid services, a user can renew a subscription before or after its expiry date, in accordance with the current CTS at that time. In the case of non-renewal, the user will continue to have access to his/her account and the content generated by the user in modules and pages accessible under his/her new subscription level (which may be a level where no subscription is necessary), but will no longer have access to the generated content and/or functionality corresponding to the expired subscription level. In the case of subscription expiry or extended periods of inactivity, GLS may block access to information, as established in the Organic Law on Personal Data Protection (LOPD ). GSL will retain these data for a period of five years. During this period the user may reactivate his/her subscription by requesting reactivation by email to firstname.lastname@example.org.
GSL reserves the right to modify at any time its services, features, details, procedures and/or conditions of subscription, prices, or any other element, provided, however, that such changes will not affect the services already contracted under the current CTS. Notwithstanding the foregoing, in the unlikely event that it is impossible to provide a service previously contracted for reasons beyond GSL's control, for example due to changes in the services of a third party provider, GSL will endeavour to offer the user alternatives.
3. Hiring a career advisor.
GSL provides users that have registered the right to request advice from a Career Advisor selected from a panel of career advisors, in order to provide advice and guidance in the process of searching for a job. Users may request such Career Advisor through a form provided for that purpose, indicating the type of service required, specific needs and the maximum budget of the user for his/her request.
GSL will aim to process this request for a Career Advisor within 10 business days, looking for a Career Advisor whose profile is suitable to the help requested by the user. If GSL is unable to find a Career Advisor willing to accept the request of the user, GSL will notify the user, and will at no time be obliged to procure a Career Advisor for the user. The Career Advisor is free to accept, reject or renegotiate the service and the fee to be paid. Only the acceptance by both parties of the service agreement between the user and the Career Advisor will engage the provision of the service under the terms and conditions agreed.
GSL performs an intermediary role in defining and implementing the advisory service, providing the service agreement between the user and the Career Advisor, but not as a party to that agreement, and assumes no liability arising from the service agreement. In the case that a service agreement is formally agreed between user and Career Advisor, the user will pay GSL the fee agreed with the Career Advisor. GSL will retain a percentage of the fee agreed between the user and the Career Advisor.
Prior to the initiation of the Career Advisor's services, the user shall pay the amount to GSL, through the PayPal payment platform, and GSL in turn will pay the Career Advisor , once the services have been completed and approved by the user.
GSL will, on notification by the Career Advisor that the services have been completed, request confirmation by email from the user. If within 10 business days after the request has been sent, GSL does not receive a response from the user, GSL will consider the lack of response as tacit approval for payment, and shall pay the Career Advisor's services, the user having no right to challenge or reclaim such payment.
In the case of disagreement or dispute between the user and the Career Advisor, GSL will act as arbitrator between the parties, subject to the principles of objectivity, impartiality and professionalism. Both parties recognize the role of GSL and exempt GSL from any liability.
The user may grant the Career Advisor authorization to access the user's account with ProHireMe, including the access to personal data. GSL will not allow access by the Career Advisor to the user's account without the user's authorization.
4. Generation of content in ProHireMe.
Users are allowed to rate and review prospective employers, recommend and evaluate recruitment agencies, advisors, and content provided by ProHireMe through a series of forms provided for that purpose, for the user's own use and for the purpose of sharing market intelligence, views and advice with other users of the platform. In this case, the user agrees and accepts sole responsibility for such content, comments and/or suggestions, and that GSL does not have, nor assumes, any responsibility for them.
By posting or displaying the content mentioned, the user grants GSL a license to use it, on a non-exclusive, indefinitely, worldwide, royalty-free basis, including the rights of reproduction, public communication and making it available through ProHireMe. This license's only purpose is to promote the services offered through ProHireMe.
The user who has registered for the services of ProHireMe will have access to job offers that are published on ProHireMe. The user acknowledges and agrees that GSL does not verify or contrast the authenticity or accuracy of the information published through the platform and in particular information on employment opportunities provided using links to third party sites. GSL assumes no responsibility in this regard for the user's incurrence, based on the inaccuracy of information, in additional costs or loss or damages of any kind suffered by the user.
In the event that GSL detects that certain information is false, mistaken, inaccurate or misleading, GSL will take action in order to ask the third party provider of this false information to correct or modify it, and if this is not possible to remove it. The user also acknowledges and agrees that he/she is not allowed to publish in ProHireMe words, pictures, advertisements, materials or content that may violate applicable law and / or may be considered offensive to other users or Career Advisors, including but not limited to comments that are sexist, racist, or violate the principles of freedom and human dignity. In this case GSL will use its best efforts to remove such content.
5. Incidents accessing the services.
The user is responsible for the custody and safekeeping of his/her system password. GSL recommends that the user changes his/her password periodically in order to ensure that access to services and personal information is secure, and to prevent unauthorized access. In the event that the user becomes aware of any unauthorized use/access, he/she shall promptly inform GSL about this fact (by e-mail at: email@example.com) in order to allow GSL to block temporarily the user's account, until secure access is restored by taking appropriate corrective action.
In this case, the user acknowledges and agrees that if GSL deactivates or blocks the user's account, the user may not be able to access the account, and therefore his/her personal data, professional data and job opportunities data and information generated by the Career Advisor. GSL will use its best efforts to restore access to the user's account in the shortest time possible.
The user acknowledges and agrees that in no case GSL will be responsible for fraudulent use that third parties may make of the user's password and therefore of his/her account in ProHireMe.
The user also agrees not to access or attempt to access services offered through ProHireMe by any means other than through the interface that GSL provides.
The prices for the services shall be displayed on ProHireMe at all times, which include Spanish sales tax if applicable,and detailed in the payment confirmation to the user.
GSL reserves the right to modify at any time the prices established in which case the new prices will be applicable immediately for new subscriptions, but will not be applied to services that are already contracted and duly confirmed.
7. Right of cancellation.
The user may cancel his/her payment subscription in accordance with the following rules:
(i) The user may cancel his/her subscription at any time, without repayment of any amount paid. GSL may ask the user for certain information concerning the reasons for the cancellation requested.
(ii) In the case of a monthly subscription contracted via PayPal, the cancellation of the subscription need to take place via PayPal.
The user must notify GSL of his/her wish to exercise their right of cancellation by email to firstname.lastname@example.org within the time applicable, as described in the preceding paragraph. For this purpose, the user may use the cancellation document attached to these CTS as Annex I, or otherwise provide the information requested therein. After verifying that the user meets the requirements in paragraph (i) GSL will process the repayment of amounts paid through PayPal, within thirty (30) calendar days from the date of notification of cancellation
In any case of cancellation, the user, having previously notified GSL, GSL will proceed to deactivate or modify the user's account. Access to the user's data and information, its blocking and data retention will be subject to the provisions in paragraph 2 of these CTS.
8. Guarantees of GSL
As part of the continuous improvement of the service, the user acknowledges and agrees that temporary discontinuance of service may happen due to the implementation of technical work to improve and update the system. However, GSL may cease to operate ProHireMe at any time, permanently and at its sole discretion. In this case GSL may compensate those users with valid and active subscription agreements according to the CTS, by refunding the portion of the amount paid by the user corresponding to the remaining term of the subscription, so long as a minimum period of one month is outstanding.
The user may contact GSL via email email@example.com to enforce the performance of this guarantee.
9. Personal data protection.
GSL reserves the right to modify at any time the terms of these CTS.
Such amendments shall be notified by publication of the new text, with an indication of the date of entry into force (being the date of publication). Please, periodically check the link to the CTS and in any case, prior to completing any subscription or Career Advisor service agreement.
In the event that a competent authority should annul any provision of this CTS, the remaining provisions shall remain valid and binding on both parties, unless that authority decides otherwise.
12. Law and jurisdiction.
The present CTS are governed by the laws of Spain. The parties submit, at its option, to resolve conflicts and to waive any other jurisdiction, to the courts of Madrid (Spain).
